General Terms and Conditions (GTC)
1. Scope
1.1 These General Terms and Conditions (hereinafter "GTC") of Thomas Grüneberg, trading under "1ATOYS" (hereinafter "Seller"), apply to all contracts for the supply of goods that a consumer or business (hereinafter "Customer") concludes with the Seller regarding the goods presented in the Seller's online store. The inclusion of the Customer's own conditions is hereby rejected unless otherwise agreed.
1.2 These GTC also apply to contracts for the delivery of vouchers unless otherwise stated.
1.3 A consumer within the meaning of these GTC is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business, or profession.
2. Conclusion of Contract
2.1 The product descriptions contained in the Seller's online store do not constitute binding offers by the Seller but serve as an invitation for the Customer to submit a binding offer.
2.2 The Customer can submit the offer via the Seller's online order form. By placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the Customer makes a legally binding offer to purchase the goods in the shopping cart by clicking the final order button.
2.3 The Seller may accept the Customer's offer within five days:
- By sending the Customer a written order confirmation or a confirmation in text form (e.g., email), where receipt of the order confirmation by the Customer is decisive,
- By delivering the ordered goods to the Customer, where the receipt of the goods by the Customer is decisive, or
- By requesting payment from the Customer after placing the order.
The period for accepting the offer begins on the day following the offer submission by the Customer and ends at the close of the fifth day following the submission. If the Seller does not accept the Customer’s offer within this period, the offer is deemed rejected, and the Customer is no longer bound by their declaration of intent.
2.4 If the Customer selects a payment method offered by PayPal, the transaction is processed via PayPal (Europe) S.à r.l. et Cie, S.C.A., 22-24 Boulevard Royal, L-2449 Luxembourg, subject to PayPal's terms of use, available at:
By selecting a PayPal payment method, the Seller immediately accepts the Customer’s offer when the Customer clicks the final order button.
2.5 The contract text is stored by the Seller and sent to the Customer after placing the order in text form (e.g., email). No further access to the contract text is provided by the Seller.
2.6 Before submitting a binding order, the Customer can identify and correct potential input errors using standard browser and keyboard functions.
2.7 The contract is available in German and English.
2.8 Order processing and communication are generally carried out via email and automated order processing. The Customer must ensure that the email address provided is accurate so they can receive emails from the Seller. The Customer must also ensure that spam filters do not block the Seller’s emails.
3. Right of Withdrawal
3.1 Consumers generally have a right of withdrawal.
3.2 Detailed information regarding the withdrawal policy can be found in the corresponding section (see Right of Withdrawal).
3.3 Exclusion/Early Expiry of the Right of Withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are custom-made based on the Customer’s specifications or that are clearly tailored to personal needs.
3.4 The right of withdrawal does not apply to consumers who, at the time of concluding the contract, do not belong to a member state of the European Union and whose sole residence and delivery address at the time of contract conclusion is outside the European Union.
4. Prices and Payment Terms
4.1 Unless otherwise stated in the product description, the prices listed include statutory VAT. Any additional shipping costs are specified separately in the respective product description.
4.2 The available payment options are displayed in the Seller’s online store.
4.3 If prepayment by bank transfer is agreed upon, payment is due immediately after contract conclusion unless a later due date has been agreed upon.
4.4 If the Customer selects a payment method via Stripe, the transaction is processed via Stripe Payments Europe Ltd., 1 Grand Canal Street Lower, Grand Canal Dock, Dublin, Ireland. The available Stripe payment methods are displayed in the online store.
4.5 If the Customer chooses credit card payment via Stripe, the amount is due immediately upon contract conclusion. Stripe may conduct a credit check and refuse the payment method if the check is negative.
5. Delivery and Shipping Conditions
5.1 The delivery of goods is carried out within the specified delivery area to the address provided by the Customer unless otherwise agreed.
5.2 If delivery fails due to reasons attributable to the Customer, they bear any additional costs incurred.
5.3 If the Seller does not receive proper and timely delivery from their supplier, they may withdraw from the contract. The Customer will be promptly informed, and any payments will be refunded immediately.
6. Retention of Ownership
6.1 The Seller retains ownership of the goods until full payment is received.
7. Warranty and Liability
7.1 Unless otherwise stated, the statutory warranty rights apply.
7.2 Limitations of liability do not apply to claims for damages due to:
- Intent or gross negligence,
- Injury to life, body, or health,
- Fraudulent concealment of defects,
- Mandatory updates for digital products.
8. Liability
The Seller is liable for:
- Intentional or grossly negligent conduct,
- Injury to life, body, or health,
- Product liability laws.
For slight negligence, liability is limited to foreseeable, contract-typical damages.
9. Redemption of Promotional Vouchers
9.1 Promotional vouchers issued for free in advertising campaigns are redeemable only within the specified period and only in the Seller's online store.
9.2 Promotional vouchers can only be redeemed before completing the order process.
9.3 Only one voucher can be used per order.
10. Redemption of Gift Vouchers
10.1 Gift vouchers purchased in the Seller's online store can be redeemed exclusively in the store.
10.2 Gift vouchers and remaining balances are valid for three years after the purchase year.
10.3 The voucher balance is neither paid out in cash nor earns interest.
11. Governing Law
11.1 The laws of Germany apply, excluding international sales laws. This does not affect consumer protection regulations in the Customer’s country of residence.
11.2 The right of withdrawal does not apply to consumers outside the European Union.
12. Alternative Dispute Resolution
12.1 The European Commission provides an Online Dispute Resolution (ODR) platform at:

12.2 The Seller is not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
